<\/p>\n<hr>\n<p><strong>How China\u2019s \u2018crooked consultants\u2019 help the rich enter Canada<\/strong><\/p>\n<p>MARK MacKINNON<br \/>\nBEIJING\u2014 From Saturday&#8217;s Globe and Mail<br \/>\nPublished Friday, Apr. 22, 2011 9:22PM EDT<br \/>\nLast updated Saturday, Apr. 23, 2011 6:56PM EDT<\/p>\n<p>He is in his 50s and has spent his entire career in the quality-control department of a company owned by the Chinese government. His salary isn\u2019t much, but he has made millions on the side \u2013 he won\u2019t say precisely how \u2013 and now wants to emigrate to Canada.<\/p>\n<p>There is a special program designed to fast-track immigrants with money to inject into the Canadian economy, but he doesn\u2019t really qualify.<\/p>\n<p>He has the required minimum of $1.6-million in assets. What he doesn\u2019t have are the documents Canadian immigration officials want: neither banking and pay statements to show that his wealth has accumulated gradually and legitimately nor proof that he has paid taxes on it. He also doesn\u2019t have the necessary two years\u2019 experience in managing employees.<\/p>\n<p>In China, however, manufacturing a personal history that will satisfy Immigration Canada is no problem for almost anyone willing to pay.<\/p>\n<p>To overcome his obstacles, the well-off quality-control officer approached 22 China-based immigration consultants for advice. He soon found that his destination is so popular for wealthy people like him that a black market has arisen to generate the forged documents and massaged back stories that so many seem to need.<\/p>\n<p>And the image doctors appear to be good at what they do: Several claim to have a 100-per-cent success rate. \u201cIf you make a fake,\u201d observed a consultant in the southern city of Guangzhou, \u201cyou should fake it real.\u201d<\/p>\n<p>That admission was surprisingly frank, considering that it was made over the telephone to a caller whose own identity was no more genuine than the one he wanted to have fabricated. In reality, the quality-control officer was a character invented by The Globe and Mail to see just how far people will go to help someone leave  China.<\/p>\n<p>Disreputable consultants have long been the subject of controversy in Canada. Just before the May 2 federal election was called, Bill C-35 was read into law, making it illegal for anyone who isn\u2019t unregistered to charge a fee for immigration advice.<\/p>\n<p>But a bigger threat may lurk abroad. More than 80 per cent of the companies The Globe\u2019s counterfeit client asked for help offered to sugarcoat the past, even if it includes a criminal conviction and time in jail.<\/p>\n<p>Immigration Minister Jason Kenney confirms that \u201ccrooked consultants\u201d in such places as India, Pakistan and especially China are a problem. \u201cA lot of people,\u201d he said in an interview, \u201care willing to pay a lot of money to cut corners.\u201d<\/p>\n<p><strong>Canada-China relations thorny<\/strong> <\/p>\n<p>For years, China has been the No. 1 source of newcomers to Canada, and applying as an investor is the fastest route to permanent resident status. Permission to come is often granted within a year.<\/p>\n<p>In 2009, about 2,000 investor immigrants and their families were accepted from China, most of them private citizens drawn by the promise of a better environment, education system and health care.<\/p>\n<p>A report in Friday\u2019s Global Times newspaper found that among those Chinese with at least 100 million yuan (about $15-million) in assets, 27 per cent had already begun the process of emigrating, and another 47 per cent were also considering leaving the country.<\/p>\n<p>Consultants in China say that those being fast-tracked also include public employees, who, like the quality-control officer, are surprisingly well off.<\/p>\n<p>Ying Hong, a Guangzhou firm that bragged of its 100-per-cent success rate, made no secret of helping wealthy bureaucrats. \u201cMany officials take foreign passports,\u201d the agent said, laughing. \u201cBut I can\u2019t tell you who.\u201d<\/p>\n<p>China\u2019s relationship with Canada is often thorny, and one of its more charged issues is the claim that Ottawa provides refuge to at least 70 fugitives, including former government officers accused of corruption. Beijing says Canada turns a blind eye to immigrants\u2019 shortcomings if they have money \u2013 and then refuses to extradite those who stand accused of serious crimes.<\/p>\n<p>At the top of the most-wanted list is Lai Changxing, who is suspected of masterminding China\u2019s biggest-ever smuggling ring and has been in Canada fighting extradition since 1999. Although he entered on a visitor\u2019s visa and is trying to stay as a refugee, his case has demonstrated how reluctant Canadian courts are to deport people to China, where serious economic crime often results in the death penalty.<\/p>\n<p>Canada, meanwhile, blames Beijing for not cracking down on those who profit by helping dodgy migrants cheat its system.<\/p>\n<p>An estimated 400 firms based in China offer their services to prospective immigrants. Of the 22 approached by The Globe\u2019s fictitious client, no fewer than 18 advised fabricating documents to produce the required background.<\/p>\n<p>Although many suggested he ask someone who owns a company to create the income and tax documentation, eight said they could produce the papers themselves. Two even offered to have a Canadian company speed the process by hiring the applicant, if only on paper.<\/p>\n<p>The fees for all this ranged from 50,000 to 60,000 yuan ($7,500 to $9,000). \u201cWe are not charging you 50,000 for doing nothing,\u201d said a representative of Ying Hong, adding that \u201cwe have succeeded with clients who have several hundreds of millions in assets, a lot of money, that they can\u2019t report.\u201d<\/p>\n<p>As a further test, The Globe\u2019s client claimed to have a relative who also wanted to emigrate but had an even bigger problem: Several years ago, he served time for stabbing someone in a fight.<\/p>\n<p>Several firms called the jail sentence a deal breaker for immigration to Canada, but 12 of them suggested that a certificate attesting to a clean criminal record can be obtained if a person possesses the right guanxi, which means \u201crelationships\u201d or \u201cconnections.\u201d<\/p>\n<p>If the relative were to persuade \u2013 bribe, if necessary \u2013 someone at his local police station to issue such a certificate, explained an agent at Kunpeng International, a Beijing-based firm, Canadian officials \u201ccan\u2019t come to China to check the archives\u201d in person.<\/p>\n<p><strong>Attracting the wealthy<\/strong><\/p>\n<p>Last year, Immigration Canada doubled both the minimum assets investors need to qualify (from $800,000) and how much each must invest (from $400,000) in a bid to ensure, Mr. Kenney said, that Canada gets \u201cadequate value\u201d for fast-tracking an application. The money is effectively an interest-free loan to the province in which the investor settles, and is later repaid in full.<\/p>\n<p>However, China-based consultants reported no drop-off in either the number of applicants they were seeing or the pace with which the cases were handled by Canadian officials. Quebec has its own immigration program, and was compelled to raise its standards when the federal government did.<\/p>\n<p>Mr. Kenney said the government is reviewing the effectiveness of the new threshold \u2013 which still makes coming to Canada cheaper for an investor than going to Australia, the United States or Britain, all of which require an investment of at least $1-million, which isn\u2019t repaid.<\/p>\n<p>But he defended the need to have a fast-track program: \u201cObviously, we do want to attract high-net-worth individuals. Our hope is they\u2019ll stay in Canada and be a positive force in the economy.\u201d According to a report in a state-run Chinese newspaper, the 2,000 investors who emigrated in 2009 transferred almost $1-billion to Canadian banks.<\/p>\n<p>The minister acknowledged that embassy officials struggle with the sheer volume of applications from China \u2013 which accounted for more than 32,000 of the 45,000 the program received in total last year.<\/p>\n<p>He also described as \u201ca challenge\u201d attempts to have Chinese police co-operate in pursuing consultants suspected of fraud, but contended that relations improved after he raised the issue in Beijing last year with Public Security Minister Meng Jianzhu.<\/p>\n<p>John Ryan, chief executive officer of the Canadian Society of Immigration Consultants, agrees that, along with guanxi, the inability of officials to verify documents is at the root of the problem.<\/p>\n<p>But he spent nine years as a consultant in China and observes that the bureaucratic landscape there is very different: \u201cIn Chinese culture, they feel that, in dealing with governments, they need an edge. They don\u2019t really understand that, in our Canadian system, they can deal openly and honestly with the government and be dealt with fairly.\u201d<\/p>\n<p>According to Mr. Ryan, staff at the embassy in Beijing \u2013 which declined to comment for this article \u2013 are \u201cdoing yeoman\u2019s work, but the time that they spend on any file is limited. They have limited time to look behind the file, unless there\u2019s something glaring, and those [Chinese immigration consultants] are sophisticated enough to know where the holes are.\u201d<\/p>\n<p><strong>No choice but to cheat<\/strong><\/p>\n<p>In their own defence, some consultants say they have no choice but to break the rules. Canada, they claim, asks for documents that even legitimately wealthy Chinese are unlikely to possess.<\/p>\n<p>One official, whose company did not suggest doing anything illicit, complained that immigration officials demand a perfect background, something that is rare among those who have become wealthy during China\u2019s wild transition from socialism to a market-oriented economy.<\/p>\n<p>Many of the nouveau riche, the consultant said, earned their money legally through stock trading or because real-estate values have soared in Beijing and Shanghai. So they have the requisite assets but not all the paperwork.<\/p>\n<p>Charles Qi, president of Beijing East J&#038;P Star Consulting Co. and a member of the Canada-China Business Council, said that, if an applicant is determined to leave and knows his acceptance depends on documents he doesn\u2019t have, \u201che will fake them. What other choice do they have?\u201d<\/p>\n<p>Mr. Kenney rejects the notion that Canada has set the bar too high, saying it is still more difficult to gain residency in the United States and Britain, and that there is no good reason to falsify an application.<\/p>\n<p>But a veteran consultant who divides his time between China and Canada argues that honesty has become a handicap. He said the investor system is now so rife with fraudulent applications that anyone who fails to add some \u201cpolish\u201d almost certainly winds up at the back of the line.<\/p>\n<p>\u201cI kept silent for many years and tried to \u2026 play by the laws, but I\u2019m almost ready to close my company,\u201d he said, speaking on condition of anonymity. (He fears being harmed for revealing what his competitors do.) Because he won\u2019t cheat, \u201cI can\u2019t compete. People who come to me are unlucky people. They are the ones in danger of refusal.\u201d<\/p>\n<p><strong>Investor immigration<\/strong><\/p>\n<p>Citizenship and Immigration Canada has set up special \u201cbusiness immigration centres\u201d in nine cities around the world, making investor applications an especially rapid route to permanent residency. You should have 10 million (yuan) in assets. It costs 1.5 million, and it will take a one year or so. There is another way called warrant of assessment which you will spend about 1 million, equal to 150,000 Canadian dollars. It will also take about a year or so. <\/p>\n<p>GM: Wait a minute. What is the first option? <\/p>\n<p>The first option is a bit stricter. It needs you should have over 10 million assets. And your house and savings should have the identification documents to show them. They will estimate the value. And you will have to spend 1.5 million and won\u2019t get it back. It\u2019s for the federal [program]. And you should also have over three years of executive management experience, such as vice general manager or higher title. The second option is different. There is no condition of your assets. It requires 1.6 million Canadian dollars assets, which is about 10 million RMB. They definitely require two years of executive management experience. Regarding your situation, is it possible for you to find a company which will allow you to attach yourself to them? It means they say that you are working there as an executive manager, or your wife used to be an executive manager in the company, or has the company\u2019s shares. That works too. <\/p>\n<p>GM: It\u2019s not so easy to find\u2026 <\/p>\n<p>Have you ever considered other countries? <\/p>\n<p>GM: I feel Canada\u2019s environment is pretty good. I prefer Canada. <\/p>\n<p>If so, there are two options. One is that you need to find a company which can prove you are the executive manager. Our company will help look for a proper company for you and make some documents. <\/p>\n<p>First, we need to be able to prove you are the executive manager of the company, which means you need to provide the relative employment contract, and the pay records of the employees who are under your administration, etc. The main purpose is to prove that you are the executive of that company. <\/p>\n<p>Second, we need to prove your income. It costs about 150,000 Canadian dollars. <\/p>\n<p>GM: One hundred and fifty thousand dollars? <\/p>\n<p>You have to understand if a company needs to hire someone from anther country, so it can\u2019t be a small company. Normally, it\u2019s a working visa, but could start applying for the immigration after working for two years over there. But in the second option as I told you, we can directly apply for the immigration for you\u2026 .We only charge you 50,000 RMB for our service. <\/p>\n<p>GM: How fast is the first option? <\/p>\n<p>It will also take a year or so, but it requires more strict application materials. First, you need to prove your income. You may have the houses, funds, stocks, and other bank stuff. Your house, we need to take a simple value assessment. But they require us to show the purchase record from when you bought the house. <\/p>\n<p>For example, you have a house valued at four or five million RMB. In the beginning, you paid, for example 300,000, they need to see how this 300,000 comes from, for example, maybe it\u2019s from your salary income. It requires a lot of documents. <\/p>\n<p>As you have no managing experience, there are many things that our company has to help you to make. First, we need to find you a company; Second, we need to make all of the above materials for you. Our working load is quite heavy. <\/p>\n<p>GM: I have a brother who also wants to immigrate. He has the criminal experience, if that\u2019s the right term for it. Is it easy to have him immigrate with me? <\/p>\n<p>It depends on the situation. House arrest is fine. If he was imprisoned, it takes more effort, because we need to show a non-criminal certificate issued by the local police station. It\u2019s unavoidable. &#8230; If he can\u2019t get it, it\u2019s quite troublesome. <\/p>\n<p>GM: How can he\u2026 <\/p>\n<p>Well, guanxi (personal connections, or a bribe)\u2026 find somebody\u2026 the immigration bureau won\u2019t investigate it very strictly. It\u2019s just up to the police station which we can get it issued from. The immigration bureau won\u2019t check whether an applicant really has no criminal record or not, because it is from the government \u2026 it has credibility. <\/p>\n<p><strong>(Subsequent call, Feb. 28, 2011) <\/strong><\/p>\n<p>GM: Do you have a good rate of success? <\/p>\n<p>Quite high. Our company was founded in 2001. Last year we were named one of top 10 agencies in China. It\u2019s quite an award. We are not a small agency. If you have time, you can come over. We have a working licence, etc. You can have a clear view [of us] when you come by. <\/p>\n<p>GM: I heard I will also need to do an interview (with Canadian immigration)? <\/p>\n<p>The federal program has the possibility of an interview. It\u2019s mainly up to how well we prepare the materials and the application. It is possible to have an interview. <\/p>\n<p>GM: Is it easy to pass? <\/p>\n<p>It\u2019s quite easy. Before you head to interview, we will tutor you. The interview is not to test your language skills, but you are quite likely to be asked about your past experience. For example, if we say you are working in the clothes factory of your friend or relative, they may ask the structure and the source of your money. You can answer according to your papers. After you get the visa, you go to Canada. When you get off the plane, there is a special immigration bureau office. You need to fill in some forms there. And the green card will be issued to you within two months. All of these are just procedures. There won\u2019t be another investigation into you. You don\u2019t need to worry. Besides, there are some nominee investor immigration programs that I suggest you to consider. They are different tunnels but reach the same result \u2013 having a Canadian immigration card. Those programs require less assets, three to four million yuan, but also have the condition of management experience. But we can help you find a way: For example, you may have friends or relatives who own their own company. You can request help from them to issue you some\u2026for example, an executive manager\u2019s position. <\/p>\n<p>GM: Oh, issue a paper to prove \u2026 <\/p>\n<p>Yes, you can do it in this way. The management experience is not very strictly required by the provincial immigration bureaus. If you can find a company of your relative or friend, and they can provide you such things as the operating licence, the company\u2019s tax registration certificate, the employment contract between you and the company as well as some papers about what position you are taking in the company, your annual income, etc. If you can make all of these, you can consider the Canadian Nominee Investor Immigration programs. <\/p>\n<p>GM: Okay, I have a cousin who has a criminal record, but he also wants to immigrate. <\/p>\n<p>Ah \u2013 it doesn\u2019t work if someone has a criminal record. <\/p>\n<p>GM: Oh, is there any way? <\/p>\n<p>The way, how can I say it, is if he can handle the local police station &#8230; By handle, I mean the police station can issue him the non-criminal certificate if he asks. They (Canadian officials) can\u2019t come to China to check in the police archives whether he had a criminal record or not. <\/p>\n<p>GM: Oh, needs to find people? <\/p>\n<p>Certainly. He had the criminal record. But some of the third-party charge won\u2019t be included, such as the fee of notarization, delivery, many papers you need to deliver to Canada, the fee to pay lawyer of Canada. <\/p>\n<p>GM: But how can I find a company and ask the company to issue some papers for me? <\/p>\n<p>This stuff takes efforts. The things which are too fake are hard to make, because a lie needs another lie to cover it. A little mistake among them will destroy the whole thing. <\/p>\n<p>GM: But do you have ways? <\/p>\n<p>We do have ways, but we need to talk in person for details. <\/p>\n<p>GM: Have you done many cases like my situation? <\/p>\n<p>Yes, we have. English and Canadian (immigration) I recommend, because once they issue it to you, it\u2019s permanent. America and Australia are both temporary. Canada is a good country with a clear policy. Once you reach their conditions, they will issue you a five-year card. You need to stay there for two years of these five years. And then they will extend it for another five years. If you want to apply to change to Canadian nationality, you need to stay there for three years out of the five. After you are a Canadian citizen, it\u2019s okay for you to return to China and stay whatever, 100 years.
